ARTICLE 1 – SCOPE
These general sales conditions apply to the sale of all products (hereinafter referred to as "Products") offered on this website (hereinafter referred to as "Site"). The publisher is "FIT-HERO.SHOP", Tel: +393495027889. Placing an order implies full acceptance by the customer of the full terms of the site, excluding all other terms.
ARTICLE 2 – PRODUCTS
All characteristics of each product are recorded by the customer. Photos on the website are not the responsibility of the seller.
ARTICLE 3 – PRICE OFFERS
Promotional offers are only valid as long as they are online and available. The prices listed on this website are in Euros, including all taxes, excluding shipping costs (see Article 7), and may change throughout the year, provided that the ordered products are paid for at the prices during the order.
ARTICLE 4 – ORDER
The order is finalized by clicking the "Confirm Cart" button. By confirming the order and clicking the "Proceed to Checkout" button, the customer accepts all sales conditions. The customer's order will be subject to a receipt confirmation, which will send the order details to the provided email address. This confirmation will list the exact amount and specify the delivery method of the order. The seller reserves the right to cancel any order from a customer with an outstanding payment or a dispute regarding payment of a previous order, or for any other legitimate reason, particularly due to the unusual nature of the order.
ARTICLE 5 – AVAILABILITY OF PRODUCTS
The product offering on the website is only valid within the limits of available stock. In the event of product unavailability after placing the order, the seller must inform the customer within 8 days and provide an estimated wait time for receiving the product. The customer has the option to request the cancellation of the order (payment by transfer to the customer’s account will be used for payment of the order within 15 days) or to exchange the order by email at INFO@fit-hero.shop.
ARTICLE 6 – PAYMENT
6.1 Payment Methods
The customer must pay for the order using one of the payment methods offered on the website. Transactions on the website are exclusively in Euros. Online payment by credit card is completely secure.
Ownership Reservation: The products remain the property of the seller until the price has been fully paid by the customer. Personal data and information about you are necessary to manage your order and maintain our business relationships. These may be sent to companies that contribute to these relationships, such as those responsible for managing, executing, processing, and paying orders.
This information and data are also stored for security reasons, to comply with legal and regulatory obligations, to improve the services we offer, and to personalize the information we send you. In accordance with the data protection law of January 6, 1978, you have the right to access, correct, and object to personal data about you.
6.2 Security of Card Payments
Transactions are processed through Mollie, Stripe, and PayPal websites, and no card information is stored at FIT-HERO.SHOP.
ARTICLE 7 – DELIVERY
7.1 Delivery Conditions
Products will be delivered to the shipping address provided during the order process. It is the customer's responsibility to provide accurate order details for successful delivery. If the customer is not present during the delivery by the carrier, they must organize the new delivery or pick up the package from a designated collection point. The delivery typically takes 2 business days after online payment of the order, and at most within the next six working days. The customer is responsible for shipping or provision costs. The delivery date may be extended by a period of seven days upon request from the customer or the seller, and it will be the delivery date of the ordered product, except in cases of force majeure as claimed by the seller. After this period, the customer can contact the seller via email to cancel the order, in which case the full amount paid must be refunded within 30 days.
7.2 Exchange or Refund Conditions
In the event of a mismatch between the received product and the ordered product or damage due to transport conditions that the customer identifies on the day of receiving the package, the seller will exchange or refund the product. The customer must inform the seller via email and specify whether they wish to exchange the product or receive a refund by completing the complaint form available on the website.
ARTICLE 8 – RIGHT OF WITHDRAWAL
The consumer has fourteen days to exercise their right of withdrawal without providing any reasons or penalties, except for any return shipping costs. In the case that the consumer can simultaneously move and where immediate services and necessary living conditions are required, they may waive this period. In this case, they would still exercise their right of withdrawal without any reasons or penalties. The period mentioned in the previous paragraph begins upon receipt of the goods or acceptance of the service offer. If the required information is not provided, the period to exercise the right of withdrawal is extended to three months. If the required information is provided within three months after receipt of the goods or acceptance of the offer, the fourteen-day period mentioned in the first paragraph will begin.
ARTICLE 9 – WARRANTY AND LIABILITY
The customer has the legal warranty against hidden defects. The seller is not responsible for non-performance of the contract in case of a defect (temporary or permanent), unavailability of the product, or in case of force majeure, malfunction, or total or partial strike of postal services and transportation and/or communication services. The seller is not liable for damages resulting from: loss of business, loss of profit, loss of opportunities, damages, or costs.
ARTICLE 10 – COMPUTER AND FREEDOM
The data entered by the customer during the order will be processed by computer and are required to create the contract. The customer has the right to object to access and modify the data that the seller, as well as the service providers, may hold. To exercise this right, the customer must send their request to INFO@fit-hero.shop.
ARTICLE 11 – MODIFICATION OF GENERAL TERMS AND CONDITIONS
Given the possible evolution of the site, the seller reserves the right to change or modify these conditions at any time. The new sales conditions will be communicated to the customer through an online change and will apply only to orders placed after the change.
